General provisions
1. These booking terms and conditions form an integral part of the short-term lease agreement for the Apartment concluded between the Guest and the Service Provider.
2. As part of the lease agreement, the Service Provider undertakes to prepare and make available the Apartment on the agreed date in accordance with the booking confirmation, in exchange for the agreed remuneration.
3. These terms and conditions of use of the apartments form an integral part of the apartment lease agreement concluded between the Guest and Holiday City Natalia Woźniak, 78-100 Kołobrzeg, ul. Sienkiewicza 28 C / 9, tax identification number: 967 110 80 48, being a party to the holiday lease agreement.
Booking
1. Before booking and concluding a lease agreement, the Client undertakes to read these Terms and Conditions. Making a booking is tantamount to accepting the Terms and Conditions.
2. Bookings can be made using an ICT system. In this instance, it is prohibited for the Client to deliver illegal content.
3. The current range of apartments available for short-term holiday rental, along with their detailed descriptions, can be found at www.holidaycity.pl
4. The Client can book an Apartment in the following way: • online, via the website www.holidaycity.pl • by email, to the following email addresses: rezerwacja@holidaycity.pl, biuro@holidaycity.pl • by phone, at +48 667 843 076
5. After booking an apartment via the online booking system, by email or by telephone, the Client will receive a booking confirmation (booking number, date of stay, booking price, address of the apartment, method of payment, cancellation policy according to the offer selected on www.holidaycity.pl, and other information regarding the accommodation. If the Client does not receive a booking confirmation, they should immediately contact a Holiday City employee by phone or email.
6. An apartment can be booked for a minimum of two nights, which is also the minimum rental period. However, the minimum rental period depends on the date of the stay, which is variable.
7. According to the regulations: Act of 28 July 2023 amending the Act – Family and Guardianship Code and certain other acts (Journal of Laws of 2023, item 1606) – the so-called Act on the Protection of Minors. 2. According to the Act of 13 May 2016 on counteracting the threats of sexual offences (Journal of Laws 2016, item 862), Holiday City has the right to identify the child staying in the apartment and their relationship to the adult they are staying with. In accordance with the applicable regulations, the staff has the right to verify the identity of the child and the adult and to request confirmation of the relationship between the child and the adult. If the child is looked after by a person other than the legal guardian, a written statement from the parents/legal guardians must be provided confirming that the child has been entrusted to the care of the indicated person.
Changes or cancellations by Holiday City
1. Holiday City is only allowed to change the booking if the apartment cannot be rented due to force majeure. Force majeure is defined as natural disasters, fire and the supplier cutting off the apartment's electricity, gas, heating or water. In that situation, Holiday City will offer the Guest to stay in a different apartment, to stay at a different time or to withdraw from the agreement and refund the paid amount.
2. In the event of a breakdown or unforeseen circumstances in the apartment, Holiday City reserves the right to provide a replacement apartment with similar parameters to the booked apartment. If the Guest does not agree to the change of apartment, the agreement is amended and Holiday City is obliged to refund the Guest the amount already paid.
Changes or cancellations by the Client
1. The change of the booking date/apartment is subject to the availability of the apartment on another date selected by the Client.
2. Changing the date may result in a change in the rental price. The prices presented on the website www.holidaycity.pl are variable due to the seasonal nature of the offer. The price of the stay will be calculated according to the currently presented price list by Holiday City. Changing the dates of the stay also means accepting the new quote.
3. The Client can make changes to the booking up to 14 days before the planned arrival, but only if the change is possible. 4. The total fee for the stay must be paid in accordance with the booking conditions. Holiday City has the right to cancel the booking after the deadline for payment of the second instalment of the accommodation fee has passed, or in the event of a non-refundable offer, the total accommodation fee.
Payment
Guests can pay for their stay using one of the following methods:
1. Online bank transfer via the payment system on www.holidaycity.pl (additional fees may apply)
2. Direct bank transfer to Holiday City's bank account
3. By credit card – through the payment system on the website www.holidaycity.pl
4. In cash – only if the holiday tax is paid
Deposit
1. The deposit is a form of security for property in the event of damage and destruction during the Client's stay.
2. The refundable deposit is a mandatory payment, made by traditional bank transfer in the amount of 400 PLN 7 days before the planned arrival. The refund will be transferred to the same account number from which the deposit was paid up to 7 days after departure.
3. The deposit amount may vary and can be determined individually for each offer. The individually agreed deposit amount will be presented to the Holiday City Client immediately during the offer presentation or, in the event of bookings made on intermediary websites, after they have been made.
4. The deposit is required to receive the check-in instructions and access codes to the apartment.
5. In the event of damage to the apartment, the deposit will be used to cover the costs of repair. The deduction of the deposit does not release the Client from liability towards Holiday City for damage caused in the rented apartment that exceeds the amount of the deposit and Holiday City's claims in this respect.
Prices
1. All prices offered by Holiday City are given in PLN and include the currently applicable VAT.
2. The calculation of the amount due for the booked services is based on the price list valid on the date of booking.
3. Utilities (water, gas, electricity, heating) are included in the accommodation price.
4. The fee does not include additional services such as: extra changes of bed linen and towels, pet stay (only dogs up to 5 kg, other animals are strictly prohibited), cleaning during the stay only on request, provision of a travel cot on request, etc. 5. Holiday City can issue an invoice at the request of the Guest, provided that this request is made in advance and the invoice details are provided.
6. Additional attractions offered as part of the stay at some facilities, such as an outdoor pool, indoor pool, children's playroom, and gym, are treated as a free addition to the stay. In the event of a breakdown, temporary deactivation of the attraction/seasonal deactivation of the attraction, these do not constitute grounds for a price adjustment.
Rules of stay
1. Check-in starts at 4 p.m. on the day of arrival and lasts until 10 a.m. on the day of departure.
2. Guests are required to notify Holiday City of their arrival time at least 1 day before their arrival date. Notification can be made by telephone or email.
3. Check-in occurs on the basis of sending check-in instructions to the telephone number indicated in the booking (the booking person will receive on arrival the code for the lock box/ or electronic lock, and the code for the building). All check-in and key handover details are sent with the booking confirmation via email by a Holiday City employee, and are arranged by telephone.
4. The specific departure time and the return of the keys are arranged with a Holiday City employee the day before the scheduled end of the stay. The Guest is obliged to leave the facility in a condition not deteriorated from the state in which they received it.
5. The Guest undertakes to use the flat in accordance with its purpose, not to remove any of its furnishings and decorations from the flat, and undertakes not to copy the keys to the flat given to them for the duration of their stay.
6. The Guest is financially responsible for any damage or destruction of furnishings and technical equipment caused by them or their visitors. In this situation, Holiday City reserves the right to charge the Guest an amount equivalent to the loss incurred (this amount also includes the need to reaccommodate the next guest if the apartment cannot be restored to its previous condition by the time of the Guest's arrival), and to charge the Guest's credit card for the damage caused after the Guest's departure.
7. The Guest is obliged to secure the apartment every time they leave by locking the windows of the entrance door, and upon departure to hide the keys safely in the key box, if the apartment has an electronic lock the Guest is obliged to leave the keys with the remote control for the gate on the table in the flat.
8. The Guest receives 1 set of keys to the apartment. If the keys are lost, the Guest will be charged the value of the fee for replacing the locks and the cost of making other keys or a remote control to enter the apartment.
9. The Guest is obliged to observe quiet hours, health and safety and fire safety rules of the facility. Between 10 p.m. and 7 a.m., behaviour that disturbs residents is prohibited. In the event of a legitimate complaint to Holiday City due to the Guest's behaviour in the apartment, the person representing Holiday City shall have the right to terminate the agreement with immediate effect without any obligation to refund the remaining booking period.
10. In the event of a flagrant or hooligan breach of the rules specified in these terms and conditions, Holiday City has the right to withdraw from the agreement with immediate effect and to remove the client and their companions, assisted by the police. In this instance, the client will not be refunded for nights not used in accordance with the date of their booking.
11. Guests are required to obtain permission to fulfil their stay with an animal. Holiday City reserves the right to refuse a stay without first arranging the pet's stay with an office staff member.
12. Upon arrival at the apartment, the Guest is obliged to report any defects, faults, damage up to 5 hours after check-in. Notification should be made by text message to + 48 667 843 076.
13. In the event of a breakdown or other fortuitous event in which it is necessary to enter the apartment immediately, when the immediate presence of the Client is not possible, an employee of Holiday City may enter the apartment in order to rectify the breakdown or the resulting fortuitous event. In this event, a Holiday City employee, together with any third parties necessary to rectify the fault, should enter the premises. Holiday City will immediately inform the Client of such a situation by telephone, text message or email.
14. Holiday City accepts no legal or civil liability for claims in the event of accidents, injuries or death of Guests or third parties in the apartment during the Guest's stay. Holiday City is fully indemnified against such liability.
15. Holiday City is not responsible for items left in the apartment.
16. During the stay, the number of overnight guests must not exceed the number of persons indicated in the booking. In the event of a breach of this point, Holiday City has the right to terminate the agreement with immediate effect without being obliged to refund the remaining booking period or to impose a fine of PLN 1,000/day.
17. Holiday City shall not be liable for any inconvenience caused during the Guest's stay due to: construction or finishing work that may be conducted on the premises where the apartment is located and around it, interruption, for reasons beyond Holiday City's control, of the supply of utilities (e.g. electricity, water, central heating), noise emissions from neighbouring properties.
18. Smoking of tobacco products, including electronic cigarettes, incense and candles is strictly forbidden in the apartment - in the event of its violation, the Guest will be charged PLN 1000.
19. The Guest is obliged to report to a Holiday City employee immediately any defects occurring during their stay.
20. On the day of arrival, the Client is provided with an emergency telephone number for Holiday City in the check-in instructions, which is only used in the event of reporting urgent emergencies preventing further stay at the Property.
21. Guests of the Apartment are prohibited from taking items of equipment of the Apartment outside the Premises.
22. Extension of the stay must be reported no later than 2 p.m. on the day preceding the expiry date of the booked period. Extension of the stay will only occur as and when free apartments are available. Any unarranged extension of the Guest's departure time is tantamount to payment for the next day.
Lease Agreement
The lease agreement between Holiday City and the tenant covers the rental of the apartment only. Transport, catering and the organisation of the stay are the sole responsibility of the Guest.
Pets
Holiday City allows stays with a dog of up to 5kg, only in selected apartments. In order to make an arrangement, it is necessary to contact us by telephone or email. The Guest is fully responsible for any damage caused by the animal. The pet fee is PLN 50 per day.
A total ban on staying with pets applies at the Solny Resort facilities. Failure to declare the stay of a dog will result in a fine of PLN 1,000.
